The Fort William First Nation, Canada and Ontario are negotiating a resolution to the First Nation’s claim that the boundary of the reserve does not reflect the First Nation’s understanding of the location and size of the reserve to be set aside pursuant to the Robinson – Superior Treaty of 1850.

 

Canada, Ontario and Fort William First Nation have agreed that a basis of a land claim settlement could include a provincial Crown land component.  Ontario Crown land on Flatland Island and Pie Island, including Le Pate Provincial Nature Reserve, is proposed for transfer to Canada to be set apart as reserve for the Fort William First Nation.

 

To proceed with the final transfer, a land use amendment is required. The Crown Land Use Atlas will be amended to place all provincial Crown lands on Pie Island (including Le Pate Provincial Nature Reserve) and Flatland Islands within a single land use area to ensure that only compatible land uses are permitted until the lands are transferred to Canada.

The Fort William First Nation, Ontario and Canada are negotiating a resolution to the First Nation’s claim that the boundary of the reserve does not reflect the First Nation’s understanding of the location and size of the reserve to be set apart pursuant to the Robinson Superior Treaty of 1850.

 

Negotiations between the three parties have been ongoing since 2000. The parties have agreed that a basis of a settlement of the boundary claim could include a provincial Crown land component. 

 

The Crown land proposed for inclusion as part of a settlement includes provincial Crown lands on Pie Island, including Le Pate Provincial Nature Reserve, and Flatland Island of Lake Superior. Upon settlement, the Crown land selections would be transferred to Canada to be set apart for the Fort William First Nation, pursuant to the terms and of a settlement agreement and the federal government’s Additions-to-Reserve policy.

 

In the interim, prior to the transfer to Canada, the Ministry of Natural Resources (MNR) will manage the provincial Crown land of Pie and Flatland Islands within a single land use area and permit only land uses that are compatible with the future intent for these lands.

 

This amendment to the Crown Land Use Policy Atlas will be processed to remove Flatland Island from the Western Lake Superior Conservation Reserve (C2260);remove the Le Pate Provincial Nature Reserve land use area (P2644);and remove the remaining provincial Crown land portions of Pie Island from the Lake Superior General Land Use Area. (G2626).  These lands will be placed in a new Pie Island and Flatland Island General Use Area.

 

Before provincial Crown land is included in a final settlement, the Province of Ontario, led by the Ontario Secretariat for Aboriginal Affairs hasengaged in a public consultation process.  The Fort William First Nation and Canada participated in this process. To this end meetings have been held with individuals, the Fort William First Nation and stakeholders about their interests and how they may be affected by the proposed Crown land component.  In November 2006 three open houses were held to provide the public with the opportunity to provide input on the on the provincial Crown land component that could form the basis of a settlement.

 

The consultation process provided information on the boundary claim, sought public comment and provided information regarding proposed changes to the provincial Crown land use direction, the deregulation of Le Pate Provincial Nature Reserve, and the provincial Crown land disposition.

 

The public consultation satisfies the consultation requirements of the Class EA for Provincial Parks and Conservation Reserves (park deregulation) and Resource Stewardship and facility Development projects (disposition of Crown resources).

The removal of Flatland Island and Le Pate Provincial Nature Reserve from Ontario’s protected area system will trigger local and possible provincial interest. Actual public use of these areas is unknown; however it is expected to be minimal because of the remote nature of the islands and the lack of camping and day use facilities.

The creation of a new land use area, the removal of the provincial nature reserve and part of a conservation reserve are being proposed as the result of a government decision to transfer lands to Canada as part of a land claim settlement. This is considered a minor amendment, as the land use direction for the Crown land portion of Pie Island and Flatland Island is proposed to be modified, to ensure the islands are kept free of any incompatible or inappropriate activities until the transfer is completed.

The MNR is supporting and facilitating the land claim settlement process, which is being led by the Ontario Secretariat for Aboriginal Affairs. The basis of a settlement of the claim could include a provincial Crown land component, which has been approved by the Ontario Cabinet. The only land proposed for inclusion as part of a settlement is the provincial Crown land on Pie Island (including Le Pate Provincial Nature Reserve), and Flatland Island.

 

Public consultation was led by the Ontario Secretariat for Aboriginal Affairs and provided a one-window approach. MNR will assist in the consultation.

An extensive public consultation process included a 45-day EBR posting and three publicly advertised information sessions. In addition there were presentations and stakeholder meetings with the Municipality of Neebing and Ontario government agencies.

A total of sixteen (16) written comments and letters were received. Most of the issues concerned the land claim and not related to the land use amendment. Two areas of concern relevant to the land use and the proposed transfer of provincial Crown lands were the loss of parks and protected areas and need to have lands replaced in the parks system. The potential impact with the loss of access to Pie and Flatland Islands was raised by Métis people in the Thunder Bay area. 

 

The Ministry of Natural Resources has evaluated the removal of the Le Pate Provincial Nature Reserve from the parks and protected area system and determined that the loss of this area will not have an impact upon the representation targets of Ontario Parks, as there are other parks in the region, which represent similar earth science and life science features.

 

Consultation with Métis community members regarding use of provincial Crown lands on Pie and Flatlands was undertaken and it was determined that there was no significant impact.
